Terms and Conditions for Website Services

1. Website Design & Development

1.1 Scope of Service
Digital Marque offers custom website design and development services, including CMS websites, eCommerce websites, and ERP-integrated websites with eCommerce functionality.

1.2 Payment Terms

• CMS and eCommerce websites are billed as a once-off payment.
• ERP websites with eCommerce are billed as a 12-month subscription.

1.3 Intellectual Property
Upon full payment, the website’s design, content, and code will become the client’s property. However, third-party software licenses remain the property of their respective owners.

1.4 Elementor Pro License
All CMS websites designed by Digital Marque include the Elementor Pro Advanced Solo license for the first year. After the first year, clients are responsible for renewal costs unless the license is included in their selected maintenance package.

2. Domains & Hosting

2.1 Hosting Packages
Digital Marque offers hosting services with the following options:

• 1GB Hosting
• 5GB Hosting
• 10GB Hosting
  All hosting packages are billed annually.

2.2 Domain Registration and Renewal
Digital Marque assists with domain registration and renewal. Clients are responsible for renewal costs unless specified in their package.

2.3 Account Suspension
Failure to pay hosting or domain renewal fees may result in the suspension of hosting services.

3. Website Maintenance & Support

3.1 Maintenance Packages
Digital Marque offers three maintenance and support packages:

• Micro Maintenance & Support
• 1 Hour Maintenance and Support
• 2 Hour Maintenance and Support
  All packages can be billed on a month-to-month or annual basis.

3.2 Elementor Pro License in Maintenance Packages

• The Elementor Pro Advanced Solo license is included in all Website Maintenance & Support packages as long as the subscription runs for 12 consecutive months.
• If the subscription does not run for 12 consecutive months, the Elementor Pro license will be billed as part of the annual hosting fee.

4. Website Add-Ons

4.1 Optional Services
Digital Marque provides additional website features and functionality, which may incur extra charges. These include but are not limited to:

• Plugin installation
• Advanced customizations
• SEO optimization

4.2 Third-Party Software
All third-party software or plugins used are subject to their respective licensing terms. Renewal and licensing costs may apply if not included in your selected package.

5. General Terms

5.1 Payment Terms
All invoices are payable within 7 days unless otherwise agreed. Non-payment may result in service suspension or termination.

5.2 Service Modifications
Digital Marque reserves the right to modify its services, pricing, and terms. Clients will be notified of significant changes.

5.3 Liability
Digital Marque is not liable for any losses or damages resulting from website downtime, hacking, or other unforeseen events.

5.4 Governing Law
These terms and conditions are governed by the laws of South Africa. Any disputes shall be resolved in the courts of Johannesburg.
